In accordance with article 64 of Legislative Decree no. 206/2005, if the customer is a consumer (namely a natural person who purchases the goods for reasons not related to his/her professional activity, or without indicating a VAT no.), he/she has the right to withdraw from the purchase contract for any reason, without having to provide an explanation and without any penalty, unless indicated herein below.

To exercise his/her right of withdrawal, the customer must send written communication to this effect to LICA S.r.l., within ten days of the date of receipt of the goods, via registered letter with acknowledgement of receipt, to LICA S.r.l., Corso Susa 32, 10040 Caselette Torino, Italy.

Once the above-mentioned notification of withdrawal has been received, LICA S.r.l. will promptly provide the customer with instructions on how to return the goods which must be received within ten days of authorisation.

The right of withdrawal is, however, subject to the following conditions:

  • the goods purchased must be intact and returned in the original packaging, complete with all the parts (including packaging and any documentation and accessories provided);
  • to limit any damage to the original packaging, it is recommended, where possible, to place it inside another box. In all cases, the placement of labels or adhesive tape directly on the original packaging of the product should be avoided;
  • by law, the cost of shipping to return the goods will be borne by the customer;
  • shipping, until acknowledgement of receipt by our warehouse is notified, is under the complete responsibility of the customer;
  • in the event of damage to the product during transport, L.I.C.A. S.r.l. will notify the customer thereof (within five working days of receiving the damaged goods at its warehouses) to allow a complaint to be filed with the courier chosen by L.I.C.A. and to obtain the refund of the value of the goods (if insured); in this case, the product will be given to the customer for return whilst the request for withdrawal is cancelled;

LICA S.r.l. will not be held responsible in any way for damage to or theft/loss of goods returned using uninsured shipment.

Without prejudice to any replacement costs for damages ascertained to the original packaging, LICA S.r.l. will refund the customer the entire amount already paid, net of any shipping costs incurred, within ten days of the return of the goods, via the cancellation procedure of the amount debited to the credit card or by bank transfer. In the latter case, it will be the customer’s responsibility to promptly provide the bank coordinates with which to obtain the refund (IBAN code of the recipient of the invoice).

The right of withdrawal is forfeited entirely if the goods are not intact (packaging and/or its content), in the cases where LICA S.r.l. ascertains:

  • the absence of the external packaging and/or original internal packaging;
  • the absence of any part of the product;
  • damage to the product for reasons not pertaining to its transport.

In the event of waiver of the right of withdrawal, LICA S.r.l. will return the goods purchased to the sender, charging the cost of shipment to the latter.
